  1. ON BLOCKCHAIN TRANSACTIONS

Blockchain technology functions as a shared and immutable ledger that facilitates the process of recording transactions and tracking assets (both tangible and intangible). Virtually anything of value can be tracked and traded on a blockchain network, reducing risk and costs for all parties involved.

By design, this technology generates a continuously growing list of data records, called blocks. Each block includes a cryptographic hash of the previous block, a timestamp, and other transaction-related data. One of its key features is immutability: information stored in a block cannot be added, deleted, or modified without changing the hash value used as a link in the following block. No participant can alter or falsify a transaction once it is recorded in the shared ledger. If a transaction record includes an error, a new transaction must be added to reverse it, but both transactions will remain visible.

Blockchain technology is a core component of our platform concerning digital asset transactions.

Regarding this Privacy Statement, please note that due to its nature, you will not be able to modify or correct any transaction you perform on blockchain, in or through Berry Tech Inc.'s platform, nor will it be possible to delete any personal data required by the blockchain for that transaction.

Generally, when you conduct a crypto-asset transaction, the following personal information will be recorded on the respective blockchain:

  • Source wallet address

  • Destination wallet address

  • Transaction amount

  • Transaction date and time

As explained above, once the transaction is confirmed, all this information is no longer under our control, and we cannot assist you in exercising your rights over it. Each block is inextricably linked to its predecessor and successor chronologically. Once data is recorded in a block, it is virtually impossible to alter or delete it.

This characteristic of blockchain may affect your ability to exercise certain rights as a data subject, such as erasure or rectification. While some smart contracts may restrict certain personal information from third parties, the data remains on the blockchain and cannot be removed.

In summary, if you want to ensure that your rights are not affected in any way, avoid conducting transactions on blockchain, as certain prerogatives may not be fully available or enforceable. Blockchains are generally public, and any personal data published on them will be publicly accessible.

  1. HOW LONG WE STORE YOUR PERSONAL DATA

Berry Tech Inc. will retain your personal data as long as it is necessary to fulfill the purposes for which it was collected, to meet regulatory or legal requirements, or for the duration of the statute of limitations for potential legal or contractual liabilities, or if it could impact the legitimate rights or interests of Berry Tech Inc. or third parties. Please note that certain regulations require us to retain specific information for particular periods, which could be 2, 5, or even 10 years.

To determine the appropriate retention period for each category of personal data, we consider the quantity, nature, and sensitivity of the data, as well as potential risks (stemming from unauthorized use and/or unlawful disclosure), the purposes of processing, and whether these purposes can be met through other means in accordance with current law.

In summary, from the time of registration and while the account remains active, all personal data linked to your account will remain stored. Once the legal period relevant to each specific data type has ended (or once the purposes for which the data was collected have been fulfilled), we will proceed with its deletion or anonymization, ensuring that no individual can be identified.

  1. HOW WE PROTECT YOUR PERSONAL INFORMATION

In providing our services, we apply strict technological and procedural controls to ensure the security and protection of all personal data we collect and store.

We have adopted practices such as user authentication, strict access control, data and transaction content encryption, intrusion and unauthorized access prevention and detection, information leakage prevention, periodic vulnerability testing and scanning, protection against malicious software, traceability mechanisms, access controls, computer network segmentation, and maintenance of backup copies of personal data and information, among others.

However, beyond the tools we implement at Berry Tech Inc., it is crucial that you use the platform safely by identifying and avoiding situations that may threaten the security of your personal data and our products and services.

If you detect or suspect that your account's security may have been compromised, please contact Berry Tech Inc. immediately through any of our available channels. Please note that if you conduct transactions and/or enter your data on third-party sites or services, the responsibility for protecting and storing your personal data in those locations will rest with those service providers.

  1. HOW WE NOTIFY POLICY CHANGES

As we continuously strive to improve our services, this Privacy Statement may be updated from time to time. Therefore, we recommend that you visit this page periodically to stay informed of any changes.

However, if we make significant changes that require your consent, we will publish the update and notify you via email so that you are fully informed. If you do not agree with this Privacy Statement, you should discontinue use of the platform.

This Privacy Statement is governed by the laws of the British Virgin Islands. Any dispute related to the interpretation, validity, or enforcement of this Privacy Statement shall be resolved before the Ordinary National Courts seated in the British Virgin Islands. The parties (the user and Berry Tech Inc.) expressly waive any other forum and/or jurisdiction that may otherwise apply to them.
